STATUTORY RIGHT OF WITHDRAWAL

Statutory Right of Withdrawal

EU / EEA Consumer Withdrawal

Arroway Modular Bracelets (AMB) · EU/EEA RIGHT OF WITHDRAWAL

Important Advisory: We strongly advise all clients not to size, alter, or install their AMB-001 bracelet if they have any concerns about sizing or compatibility. Please inspect your bracelet carefully upon delivery before making any modifications.

Statutory Right of Withdrawal

If you are a consumer residing in the European Union (EU) or European Economic Area (EEA), you have the statutory right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days from the day on which you, or a third party indicated by you other than the carrier, take physical possession of the goods.

Handling of Goods & Factory Packaging

To exercise your statutory right of withdrawal, items must be returned in accordance with the requirements described below. In accordance with applicable EU consumer protection law, you may handle and inspect the product only to the extent necessary to establish its nature, characteristics, and functioning.

  • Factory Packaging & Sealing: Our AMB-001 bracelets are delivered fully sealed in original factory-applied machine plastic wrapping. This factory wrap serves as our definitive indicator of a brand-new, unopened item.
  • Diminished Value Liability: You are legally liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the item.
  • Opening, Removing, or Altering the Factory Packaging: Because our products are sold exclusively as new, factory-sealed goods, opening, tearing, or removing the original factory-applied protective plastic wrapping, sizing the bracelet, mounting the bracelet onto a watch chassis, or causing scratches, marks, scuffs, or other signs of alteration may materially reduce the commercial and resale value of the product.
  • Deductions for Diminished Value: Where permitted by applicable law, Arroway Modular Brcelets, LLC may deduct from the refund the amount corresponding to the actual diminution in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the product.

Because AMB does not sell pre-owned, opened, altered, or previously handled products as new, an item returned with opened, torn, removed, or missing factory plastic wrapping, signs of bracelet sizing, mounting scuffs, scratches, or other alterations may no longer qualify as a commercially new, factory-sealed product. Where the resulting diminution in value is substantial, the corresponding deduction may be substantial, including potentially up to the full purchase price where the returned item has no remaining resale value.

How to Exercise Your Right of Withdrawal

To exercise your statutory right of withdrawal, you must inform us of your decision by an unequivocal statement before the 14-calendar-day withdrawal period expires.

You may exercise your right by:

  • Utilizing our self-service digital form located at the bottom of this page labeled “Withdraw from Contract Here”. No customer login is required.
  • Contacting our customer service team through the Contact Us page on our website and providing your order number together with your request to withdraw.

Upon receiving your withdrawal request, AMB will send an acknowledgement of receipt by email without undue delay.

To protect yourself against potential disputes concerning the condition of the goods during return transit, we strongly recommend replying to our confirmation email with clear photographs demonstrating that the factory-applied machine plastic wrapping remains fully intact before shipping the product back to us.

Return Shipping Obligations

  • Cost of Return: You are responsible for the direct cost of returning the goods to Arroway Modular Brcelets, LLC (AMB). AMB does not provide prepaid international return shipping labels for statutory withdrawals.
  • Trackable Return Service Required: All statutory returns must be sent using a secure, trackable shipping service that provides a shipment tracking number and delivery confirmation. You are responsible for retaining your shipping receipt and tracking information until the return has been confirmed as delivered to AMB.
  • Risk of Loss: You are responsible for the item until it is safely delivered back to our facility. AMB is not responsible for loss, damage, or delay occurring during a return shipment arranged by the customer, except to the extent otherwise required by applicable law.
  • Shipping Insurance: We strongly recommend purchasing appropriate shipping insurance covering the full value of the goods and using secure packaging suitable for international transit.

Customs Documentation for International Returns

For international returns, you are responsible for ensuring that all carrier and customs documentation is completed accurately and completely.

When completing a customs declaration for the return shipment, you must accurately identify the shipment as a returned merchandise or consumer return, where the applicable carrier documentation provides such an option, and accurately describe the goods and their value.

You must not describe the return shipment as a gift, sample, document, or otherwise provide inaccurate or misleading information in order to avoid customs duties, taxes, inspection, or other applicable charges.

Where the carrier provides a field for the reason for export, return purpose, or shipment type, you should select the option corresponding to a merchandise return or consumer return, as applicable.

Any customs duties, import taxes, brokerage charges, carrier fees, storage charges, delivery penalties, or other costs incurred by AMB as a result of inaccurate, incomplete, or improper return documentation or courier arrangements may be deducted from the refund to the extent permitted by applicable law.

Refunds and Fees

  • No Processing or Restocking Fee: No restocking, cancellation, or payment-processing fee is charged for a valid exercise of the EU/EEA statutory right of withdrawal.
  • Outbound Shipping: We will reimburse the cost of our least expensive standard delivery option offered at checkout. If you expressly selected a more expensive delivery method, such as expedited or express delivery, we will reimburse only the amount corresponding to our least expensive standard delivery option.
  • Diminished Value: Where permitted by applicable law, any deduction corresponding to the actual diminution in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods will be deducted from the refund.
  • Customs and Return-Related Charges: Any customs duties, import taxes, brokerage charges, carrier fees, storage charges, delivery penalties, or other costs incurred by AMB as a result of inaccurate or improper return documentation or courier arrangements may be deducted from the refund to the extent permitted by applicable law.
  • Refund Timing: We will process your refund without undue delay and, in any event, within 14 calendar days of receiving notice of your withdrawal. For sales of goods, however, we may withhold reimbursement until we receive the returned goods or you provide evidence that the goods have been sent back, whichever occurs first.

Refunds will be issued using the same means of payment used for the original transaction, unless otherwise agreed with you and permitted by applicable law.
